The Drisha’s mysterious lacuna

The Drisha observes an unexpected lacuna in the Tur’s codification of who may write sifrei Torah. From the baraita, this is what we would expect:

טור אורח חיים סימן לט
…תפילין שכתבן עבד או אשה או קטן עו”ג וישראל מומר פסולין וכל הפסול לכתבן פסול בכל תיקון עשייתן

Tefillin which were written by a slave, a woman, a minor, a non-Jew, or an apostate Jew are pasul, and all who are pasul to write them are pasul for any aspect of their manufacture…

But we would not expect this:

ס”ת שכתבו מאינ”י ישרף כתבו נכרי יגנז נמצא ביד מאיני או ביד נכרי יגנז ואין קורין בו…ס”ת שאמר הסופר בעודו בידו שלא עיבד העורות לשמן או שלא כתב האזכרות לשמן

Sifrei Torah written by a heretic are burned. Written by a non-Jew, buried. Found in the possession of a heretic or a non-Jew, it is buried and we do not read from it…If a sofer said that he did not write the Names of God properly…

But we remember that Gittin 45b said that everyone who was invalid to write tefillin was also invalid to write sifrei Torah. And compare the Shulhan Arukh, who does indeed have essentially the same lists under tefillin and under sifrei Torah:

Sifrei Torah written by a heretic are burned. If an idolater wrote it, it is buried. If found in the possession of a heretic, and it is not known who wrote it, it is buried. If found in the possession of a non-Jew and it is not known who wrote it, some permit its use and some say it is buried…Sifrei Torah written by an informer, slave, woman, minor, Cuthean, or apostate Jew, are pasul…If a sofer said that he did not write the Names of God properly…

This is what the Drisha actually said:

דרישה יורה דעה רפא
“כתבו גוי וכו'” עיין בבית יוסף שהביא לשון הגמרא שגם בכתבו עבד או קטן או אשה פסולים ומן התימה שלא כתבו רבינו כמ”ש באורח חיים בדין תפילין סימן ל”ט. ודוחק לומר דלא כתב כאן אלא מה שדינם לשרוף או לגנוז משא”כ בכתבו אשה דאף דאין יוצאין לקרות בה בציבור מ”מ יכולין ללמוד מתוכה דמכל מקום הל”ל האי דינא דאין יוצאין בה. שוב עיינתי ברי”ף והרא”ש שהשמיטו גם כן מימרא זו וצריך לומר שלא ס”ל כן כי אם בתפילין ולא בס”ת עיין בתשובתי שכתבתי בזה והארכתי שם בטוב טעם.

“Written by a non-Jew…” See the Bet Yosef, who quotes the Gemara, that they are pasul also if a slave, minor, or woman wrote them. It is very odd that the Tur did not write here as he wrote in Orah Hayyim of tefillin. One might say that here he is referring only to texts which must be burned or buried; this would exclude those written by women, since even though they cannot be used to fulfil the public obligation, they may be used for learning. But this is rather forced, since he should have mentioned somewhere the law regarding those which cannot be used to fulfil the public obligation. The Rif and the Rosh also omit to mention this matter, and I think that one must say that they only hold that way for tefillin, and not for sifrei Torah. And indeed, compare how the Rosh and Rif treat the two types of document:

It is taught in perek Ha-Sholeah in Gittin (45a) that we learn that a sefer Torah written by a heretic is burned. Written by a non-Jew, buried. One found with a heretic is buried. One found with a non-Jew – some say read from it, and some say bury it, since perhaps he wrote it.

It is taught in [Gittin 45b] that Rav Nahman taught: A sefer Torah written by a heretic is burned. Written by a non-Jew, buried. One found with a heretic is buried. One found with a non-Jew – some say read from it and some say bury it, since perhaps he wrote it.

As mentioned, the Drisha’s proof has not survived. One suspects the proof had something to do with the following ruling from the first chapter of Masekhet Soferim:

מסכתות קטנות מסכת סופרים פרק א
ספר תורה שכתבו מין, או מסור, או גר, או עבד, או חרש, או שוטה, או קטן, אל יקרא בו. זה הכלל, כל המוציא את הרבים ידי חובתן, אף כתבו מוציא את הרבים ידי חובתן.

A sefer Torah written by a heretic, an informer, a non-Jew, a slave, a deaf-mute, a witless person, or a minor – we do not read from it. This is the principle: if someone can fulfil the obligation of the community, so too can his writing.
